On considering the appeal

Dear Nicolas,

The Administration of the Tsentralny District of the City of Minsk has considered your appeal to the Ministry of Education of the Republic of Belarus. Based on the results of consideration, we hereby report the following.

A father and a mother have equal rights and obligations in relation to their children unless otherwise provided in the Shared Parenting Agreement or determined in court.

According to the decision of the Oktyabrsky District Court of the City of Minsk, dated December 27, 2018, the place of residence of your children was determined as the place of residence of the mother (L.A. Trafimovich).

According to Art. 73 of the Code of the Republic of Belarus on Marriage and Family, parents are the legal representatives of their minor children and advocate for their rights and legitimate interests in relations with any persons and organizations.

The minor Anthoula Anthie Cheropoulou, born in 2012, lives with her mother, who represents the interests of the child in educational, medical, and other institutions and also expresses consent (disagreement) on issues arising during the educational and upbringing process and advocates for the rights of her daughter.

The child’s mother chose to teach her daughter Anthoula Anthie Cheropoulou, born in 2012, at the Private Educational Institution “Kindergarten-Secondary School “Ikhvis” “(hereinafter – the Institution), the founder of which is the religious organization “St. Elisabeth Convent in Minsk, Minsk Diocese of Belarus Orthodox Church”. This institution is not associated with any destructive organizations.

In accordance with Article 5 of the Law of the Republic of Belarus No. 2054-XII of December 17, 1992, “On Freedom of Conscience and Religious Organizations” (hereinafter – the Law), parents or persons replacing them, by mutual consent, have the right to raise their children in accordance with their own attitude to religion. The state may not interfere in the upbringing of a child based on a certain religious worldview of the parents or persons replacing them, except in cases where the inducement to religious actions directly threatens the life or health of the child and violates his or her legal rights.

According to Part 2 of Art. 75 of the Code of the Republic of Belarus on Marriage and Family, all issues regarding the forms and methods of raising children, their education, attitude to religion, organization of free time, and other issues of raising children are decided by both parents by mutual agreement. Disagreements between parents on the issues of raising children shall be resolved in court.

In accordance with Art. 20 of the Law of the Republic of Belarus, “On Appeals of Citizens and Legal Entities”, this response can be appealed to the Minsk City Executive Committee.
